JAMESON SHORT SCREENPLAY 2010 PROMOTION

TERMS AND CONDITIONS

    1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
    2. Entry is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.
    3. To enter, individuals must write a synopsis for a three-minute short film idea of 200 words or less. The idea must be written to accommodate a budget of no more than $20,000 and must include an unexpected ending. Entrants must then visit www.johnjamesonproductions.com.au, follow the prompts to the competition entry page, input the requested details, and upload their synopsis in the required format, and submit the fully completed entry form. The Promoter reserves the right, at any time, to discard any synopsis that it deems, in its absolute discretion, to be obscene, offensive or inappropriate, or infringing upon the rights of any third party, including, but not limited to, copyright, and to subsequently disqualify any entrant that uploads such material. Without limiting the generality of the above, material that may not be accepted may include material that appeals to minors, features anyone under 18 years of age in a lead acting role, material that features excessive drinking or glamorizes drunken behaviour in any way in the Promoter's absolute discretion, or material that features excessive swearing, violence or explicit material in the absolute discretion of the Promoter.
    4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
    5. Incomplete, indecipherable, or illegible entries, as well as any submitted in the incorrect format and/or after the stated deadline will be deemed invalid.
    6. Multiple entries permitted, subject to the following: (a) each entry must be substantially unique; and (b) each entry must be submitted separately and in accordance with the entry requirements.
    7. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on literary and creative merit of the synopsisprovided. The Promoter's and judges' decisions are final and no correspondence will be entered into.
    8. Promotion commences 19/10/2010. Entries close at 10am AEDST on 28/03/2010.
    9. There will be two (2) rounds of judging. The first round of judging will be conducted by a panel of professional scriptwriters as determined by the Promoter in its absolute discretion, and will take place in during March 2010.
    10. The best six (6) valid entries as determined by the judges will each be selected as "Finalists". Finalists will be notified by telephone and email.
    11. Each Finalist will be required to submit to the Promoter a detailed screenplay of their proposed short film idea, as outlined in their previously submitted synopsis. Screenplays must be submitted in April 2010 on a deadline to be confirmed to the Finalists upon notification. Finalists will have the opportunity to attend a workshop in order to gain some advice on developing their idea into a 3-minute screenplay. The workshop will take place during April 2010, at a date and location to be determined by the Promoter in its absolute discretion. Attendance of the workshop is optional.
    12. The second round of judging will be conducted by a panel of no more than six (6) high-profile members of the film industry and will take place in Sydney during May 2010. Winners will be notified by telephone and email and/or at a Winners Announcement event to be held on a date to be determined by the Promoter during May 2010 at a location to be determined by the Promoter in Sydney, NSW. Finalists will be notified of the exact date and location of the event once such details are confirmed by the Promoter.
    13. The best three (3) Finalists, as determined by the judges, will each win the opportunity to have their screenplay produced, directed and funded by John Jameson Productions ("JJP") up to the value of $20,000 (each a "Winner" and collectively "Winners"). JJP will assemble a production team to pre-produce, film, edit and complete the three (3) winning screenplays.
    14. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
    15. Total prize pool value is up to $60,000. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
    16. All screenplays submitted by Finalists become the property of the Promoter for the duration of the promotion. Entries will not be returned to any entrant. As a condition of entering into this promotion, each entrant agrees that in the event that they are selected as a Winner, they grant the Promoter a non-exclusive licence to use their screenplay and final short film in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes.
    17. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
    18. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
    19. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
    20. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a Winner, Finalist or entrant; or (f) use of a prize.
    21. As a condition of accepting a Finalist position or a prize, the Finalists and Winners must sign any legal documentation as and in the form required by the Promoter / Prize Supplier / organisers in their absolute discretion including but not limited to a legal release and indemnity form. The "Winner's Agreement", can be viewed at www.johnjamesonproductions.com.au in the FAQ section. Winners and Finalists should seek independent legal advice prior to agreeing to sign any agreement.
    22. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
    23. Entry into this promotion constitutes consent to the Promoter using the Winner's name, image and/or voice (including photographs, film and other recordings) in any media for an unlimited period without remuneration for the purpose of promoting the John Jameson Productions Screenplay competition and marketing any of the Promoter's products (including those manufactured, distributed and supplied by the Promoter).
    24. The Promoter supports responsible consumption and recommends that alcohol be enjoyed in moderation.
